Uninsured drivers complicate things after car accidents

Getting hurt by a negligent driver is one thing, and getting hurt by an uninsured driver is something else entirely. It can be extremely frustrating to realize that not only were you injured through no fault of your own, but that getting the compensation you need will be even harder than it has to be. So what are you supposed to do when you find out that the driver who caused your accident never even bothered to get insurance? You turn toward your own insurance company. Under Louisiana state law, insurance companies are required to offer uninsured motorist coverage. Not sure if you have this coverage? The only way to opt out of this coverage is to reject it in writing, so you are most likely covered.

Insurance companies also have to provide underinsured motorist coverage. This means that if a negligent driver’s insurance does not cover all of your necessary damage, your own insurance company should kick in for the rest. The same opt out applies to underinsured coverage, so if you did not reject the coverage in writing, you should have it.

You probably expect to have to fight with the other driver’s insurance company to get what you deserve, but you might think that your own insurance company will have your back. Sadly, this is not necessarily the case. Your insurance company might try to limit your compensation, making it difficult for you to focus on what is most important — your recovery.
